Is it possible to sue for repairs?
He was driving in Ca (Oakland) on the road. There was a large truck (the kind that carries dirt / rocks / etc in front of me. While I was driving a rock truck flew and hit the windshield, leaving medium-small crack in the bottom left. I saw the rock come from the direction of the truck, but do not know if it flew from the truck bed, or if they kicked up with their wheels off the ground. I had the opportunity to document the moment, the company's truck, which is the motherboard, and I have a witness who saw him as I do. I wonder, is it possible to request the repair of my window, and / or possibly a claim for compensation if they refuse to pay? Yes, you can sue, but I doubt you will get much. If you can not prove that the rock came from the truck bed or the wheel which means you can not prove what he did. If you can not prove what he did, then all you can try is the truck was in front of you when the rock flew front of you. Moreover, unless the truck was somehow negligent in the conduct or not adequately cover the soil / rock (and I mean properly what the standard is that industry) is likely the court will ask how close they were driving behind the truck. In fact, there should be so closely behind a truck that something can fly off and hit your car. Surfing and a local friend literally saved my life from a fiery crash in Malibu Canyon one year. I was a wannabe surfer living in Malibu, CA and working at the local Savon Drugs as a scan coordinator. My local Malibu Colony friend Jay eventually got me interested in surfing and sold me two of his surfboards -- one of which was a nice blue, longish board,-- because he was desperate for cash to live. I was over at his house for several weeks surfing and refinishing the boards with fiberglass after he sold them to me.
My usual activity for the weekend was to drive 30 minutes through Malibu Canyon to go shopping, eat pizza, and see a movie on the other side of the mountains in the shops there. But for several weeks I was busy learning surfing and refinishing my boards in Malibu Colony at Jay's house.
One night me an Jay went to a local restaurant in Malibu. When I left I backed up my VW camper van , I heard a loud POP, and then my steering wheel went limp. I could turn the steering wheel 360 degrees easily with one finger. And my Volkswagon Camper Bus usually has rock hard steering. I got out and looked under the front ot the VW and I saw some linkage hanging down from my van. So I push the van the few feet back into my parking spot and made arrangements with the manager of the restaurant to leave my vehicle overnight until I could arrange a pickup. And me and Jay walked back to Malibu Colony a few blocks away.
The next day at the shop the mechanic learned what had happened. My steering linkage sheet metal box had rusted out from the inside and broken off. And with nothing to support it my steering wheel was completely useless. I eventually had to have the entire front axle replaced over a two week time period because the linkage box could not be welded back onto the van's axle.
If I would have kept to my regular schedule I most likely would have ended my life in a fiery cash at the bottom of a 200 foot cliff on Malibu Canyon road when my steering failed. But then my friend Jay was probably the real reason I am alive today not just my sudden interest in surfing.
Jay's father was a famous WW2 ace pilot who shot down 4 or 5 planes at Pearl Harbor. He was on the other side of the Hawaiian island training and got up to meet the second wave of Japanese planes that bombed Pearl Harbor. Jay let me zerox his father's flight log which documented this day. Jay father was pulled from combat late in the war because too many other Aces had been shot down and killed. The brass wanted to keep morale high and they wanted a few of the pilot aces to survive the war. He later was killed test piloting a plane at Edwards AFB in California after the war.
I heard that Jay and his brother sold their home in the Colony to Pepperdine University for $2.5 million dollars and the house was torn down for something else. So his days of simi- poverty and eating canned beans are over. Jay had asthma fairly bad and could hardly go surfing anymore. I suspect the old moldy house he lived in with his german shephard was the cause of this asthma. So maybe it was a good thing they tore the house down.
I have often seen VW vans like mine off the side of the road broken down or crashed. I am very curious if thousands of people have lost their lives in crashes when their steering went out while driving down a road at high speed. Think of it, what a rush, to be driving down the road anywhere and suddenly you hear a POP and your steer goes completely out. You and your passengers have seconds to just sit there and watch until you crash and probably die. What a rush. Surfers use these VW vans quite a lot in California and elsewhere so I wonder how many surfer dudes had one last wide ride in their Vans before they died. What a rush.
PS. We figured out how to fix this defect in VW vans. Simply install a grease nipple in the sheet metal steering box and fill the hollow area that rusts out with grease so it won't rust out. But I would not trust this fix with a used axle on a VW van which might already be rusted though most of the way.-- J.E. Ante
